Hi all,

Here goes my owes and i live in Bangalore India :

Way back in 2004 I got a HSBC Gold credit card. As I was not using it a friend of mine requested me to swipe it to pay his medical bills and assured to make the payment with in a week.

I did oblige as it was a medical emergency and swiped it for 25,000.

As my friend had assured that he himself will drop the repayment cheque to the bank within a week I trusted and did not bother to check if the payment was made or not and I got busy with my new job.

I did not receive a call from HSBC either for about a year and a half and my friend finally spilled the beans about the non repayment.

My friend told that he had made a payment of 4000/- 1 year before. I called HSBC and requested them to mail me the details of the outstanding amount but have never received it till date.

Today I received a call from HSBC to my wifes phone (God knows how they got it) and told that the outstanding due is 1,57,000.

I was shocked but the lady on the other end told that she can give me a waiver and can reduce it to only 25,000 for which the card was swiped and she shall provide me a settlement letter.

I asked for 3 days time for which she obliged and informed that she was calling me from HSBC Legal Cell
and the detailed description will be given if I drop down to their office personally.

Now I am in a deliama as my friend who works as a collection agent for another credit card bank asked me not to go their (HSBC) in person.

Can I request for an executive and hand over a crossed cheque and will they provide me a settlement letter if I provide him a cheque.

I can empathize with you but there is not a lot that you can do as Legal system is different.

1. Under Credit Card Service agreement, you can ask HSBC that why weren't statements sent to you. They are under the obligation to do so. Read RBI's Circular [ reference is somewhere on this forum or cardbhai.com]

2. Negotiate for Clean CIBIL history otherwise future loans may not come and even if they do, they will come at a cost. http://www.dalalstreet.biz/forum/india-credit-cards/settlement-of-icici-credit-card/

3. Don't pay until the negotiations are done and you have all the documentation.
